Witness One who testifies under oath to what he/she has seen, heard or otherwise observed. Damages Money that a court orders paid to party (usually the plaintiff) who has suffered a loss by another party who caused the loss (usually the defendant). Cross-claim In a civil proceeding, if there are two or more defendants, one defendant can raise a claim against another defendant. Preliminary injunction In civil cases when it is necessary to preserve the status quo prior to trial, the court may issue a preliminary injunction or temporary restraining order ordering a party to carry out a specified activity. Foster care A form of substitute care, usually in a home licensed by a public agency, for children whose welfare requires removal from their homes Challenge to the array Questioning the qualifications of an entire jury panel, usually on the grounds of partiality or some fault in the process of summoning the panel. Forcible entry and detainer Ordinarily refers to a summary proceeding for restoring possession of land to one who has been wrongfully deprived of possession Punitive damages Lawyers regularly employed by the government to represent people accused of crimes who cannot afford to hire their own. The term may also be used to refer to a private firm receiving public money to defend indigent criminal defendants.
